The UK Supreme Court’s future ruling in Scullion could be of great significance to the law of negligent misrepresentation   If the UK Supreme Court accepts the Court of Appeal’s judgment, it could result in an important narrowing of the tort, then the courts may be less likely to recognise a duty of care in commercial circumstances.  In essence, Scullion suggests that commercial clients who are not the primary recipients of  advice should obtain their own advice, rather than rely upon advise provided to third parties.
